Blue Island Disability Client Wins New Hearing

Attorney John E. Horn of the law firm of Horn & Kelley, PC, just won in the U.S. District Court another hearing for a Blue Island disability claimant. The case was Schneider v. Colvin, 12 C 9084, Northern District of Illinois, February 20, 2015. Social Security’s decision was not supported by substantial evidence because Social Security erred by not considering whether the Medical Expert’s testimony (at claimant’s second hearing) could support a finding that our client’s overall concentration was limited by an amount that would lead to an allowance of the claim. Although the Medical Expert initially testified about the effect of causalgia on our client’s arms, the Medical Expert also specifically referred to a lack of concentration from the severity of Plaintiff’s pain. The matter is remanded for a determination of the effect of our client’s pain on her concentration, persistence and pace, rather than only on the functional limitations it may cause. .
