John E Horn wins another case at the United States District Court

Attorney John E. Horn of the law firm of Horn & Kelley, PC, won a new hearing in the United States District Court for a  forty-four year-old Social Security Disability applicant who suffered from degenerative disc disease, obesity, dysthymic disorder, mood disorder, generalized anxiety disorder, personality disorder, PTSD, obsessive-compulsive disorder and ADHD.

This was the claimant’s second trip to the District Court. This hearing, just as at the last hearing, the same administrative law judge (ALJ) weighed the disabling opinion of the treating psychiatrist incorrectly. The ALJ’s decision was based on “distorted information”.  There was a failure of the ALJ to mention that the treating psychiatrist oversaw the therapist who met with the plaintiff more frequently. The ALJ also confused the response to treatment with the ability to enter the work force.
