Social Security found that listing 13.24A was met since March 16, 2012, by claimant’s prostate according to the testimony of the medical expert at the hearing. Cancer of the prostate was found by needle biopsy March 16, 2012.  There was trouble with the treatment and the medications used in the treatment in that they caused serious symptoms that precluded gainful employment.  The record documents progressive or recurrent prostate cancer despite initial hormonal intervention.  (A previous medical expert who had not completely reviewed the record found claimant capable of light work, but this opinion was rejected because the reviewer had not reviewed all the evidence.)  The treating oncologist was of the opinion that claimant had met the listing since May 28, 2013.

The claimant suffered from back pain, shoulder pain, morbid obesity, bipolar disorder, and a sleep impairment.  Social Security’s assessment of the claimant’s residual functional capacity did not address the findings of the treating psychiatrist despite giving them substantial weight, and the residual functional capacity did not include the limitation to occasional climbing and stooping found by Social Security’s own medical consultant, who was given some weight.  Social Security’s decision did not express the residual functional capacity in specific terms, failing to define the term “use.”  The absence of limitations associated with obesity was inconsistent with obesity being found severe by Social Security.

The claimant suffered from the aftermath of a cervical fusion, the aftermath of a lumbar laminectomy, obesity, and hypertension.  The District Court remanded September 24, 2013.  The Appeals Council on July 29, 2014, found claimant disabled December 1, 2010, the alleged onset date.  The Appeals Council adopted the administrative law judge’s findings of fact but assessed claimant’s residual functional capacity as sedentary rather than light and applied Medical-Vocational Guideline Rule 201.14 to allow the claim.  Usually the Appeals Council just sends the case back to the administrative law judge for another hearing.
